We believe it is usually in your best interest to negotiate the outcome in your case, when possible. You and your spouse are the two best people to make the decisions that will affect your future. However, sometimes it is impossible to settle the case and the issues have to be decided at trial. We can advise you on the advantages or disadvantages of taking your case to court. Divorces used to be so simple. . .you figured out who was at fault and divided up the assets accordingly. Now in Michigan "fault" does not technically make a difference. Michigan is a "no fault" state. A divorce may be granted in Michigan for the "no-fault" ground that there has been a breakdown of the marriage relationship to the extent that the objects of matrimony have been destroyed and there remains no reasonable likelihood that the marriage can be preserved.
Today, divorce is far more
complicated. Fault is rarely an issue and debts are traded off
for assets. Pensions and retirement plans are evaluated for present
value and usually equally divided by a means of special orders that must
comply with IRS regulations. Closely held corporations are valued by
experts and traded for other assets. The marital home is either
re-financed by one party, sold, or held jointly for a period of time and
then sold and the equity divided equally. The house no longer necessarily
goes with the children. Fathers are retaining custody more than ever
before and we enjoy the
concepts of shared parenting or joint custody. The Michigan General Court Rules require the Judgment of Divorce to include distinct paragraphs, with a title. Some mandatory paragraphs cover:
