The law offices of Keri Burnstein, P.C. is dedicated to representing men and women in the Michigan tri-county (Oakland, Macomb & Wayne) and surrounding areas involved in all aspects of family law.  We are located in Farmington Hills, Michigan and provide free consultations with flexible hours to meet all your needs.

Our office handles both divorce cases involving children and cases without children.

Most divorces, with or without children, are settled though negotiations.  We believe it is usually in your best interest to negotiate the outcome in your case, when possible.  You and your spouse are the two best people to make the decisions that will affect your future.  However, sometimes it is impossible to settle the case and the issues have to be decided at trial.  We can advise you on the advantages or disadvantages of taking your case to court.

Divorces used to be so simple. . .you figured out who was at fault and divided up the assets accordingly.  Now in Michigan "fault" does not technically make a difference.  Michigan is a "no fault" state.  A divorce may be granted in Michigan for the "no-fault" ground that there has been a breakdown of the marriage relationship to the extent that the objects of matrimony have been destroyed and there remains no reasonable likelihood that the marriage can be preserved.

Today, divorce is far more complicated.  Fault is rarely an issue and debts are traded off for assets.  Pensions and retirement plans are evaluated for present value and usually equally divided by a means of special orders that must comply with IRS regulations.  Closely held corporations are valued by experts and traded for other assets.  The marital home is either re-financed by one party, sold, or held jointly for a period of time and then sold and the equity divided equally.  The house no longer necessarily goes with the children.  Fathers are retaining custody more than ever before and we enjoy the concepts of shared parenting or joint custody.

Divorce can impact a person financially and emotionally for life.  If you have children, it will determine how you will be able to relate to your children, what role you will play in their future, and what decisions you will be involved with regarding their upbringing.  You need to choose an attorney who will listen to you and explain the law to you in simple terms.  You must be able to discuss your concerns and expectations regarding your finances and/or children, your spouse, and your future openly and honestly with your attorney.  At Keri Burnstein, PC your attorney will not only be a legal guide, but your advocate as well.

The Michigan General Court Rules require the Judgment of Divorce to include distinct paragraphs, with a title.  Some mandatory paragraphs cover:

  • Custody of the children
  • Child support and health care coverage for the children
  • Mandatory income withholding of child support
  • Parenting time with the children
  • Spousal support
  • Property settlements

Our office has the experience and knowledge to discuss with you all the information required to be in the Judgment of Divorce as well as all the information specific to your case and needs.  Keri Burnstein, PC is here for you and here to help you start the rest of your life.
